Welcome to HoverNotes. These Terms of Service govern your use of our Chrome extension and related services. By using HoverNotes, you agree to these terms and our Privacy Policy.

Service Description

  • HoverNotes is a Chrome extension that transforms video tutorials into notes with code snippets, screenshots, and AI-powered explanations
  • Notes are stored locally by default, with optional cloud storage for premium users
  • Features include video note-taking, AI processing, and Obsidian integration

User Content

  • You retain ownership of all notes and content you create
  • You grant us limited permission to process your content for AI features
  • You are responsible for the legality of content you create
  • We do not claim ownership of your Obsidian vault or its contents
  • Integration with Obsidian occurs locally; HoverNotes does not access or store data from your Obsidian vault
  • Data sent for AI processing is used only to generate notes and is not retained afterward

Intellectual Property

  • The HoverNotes extension, including its design and functionality, is owned by HoverNotes LLC and protected by copyright and trademark laws
  • You retain ownership of your content while granting us limited license to process it
  • Our AI-generated content is provided under license for your personal use

Third-Party Services

  • We integrate with Obsidian and other third-party tools but are not responsible for their performance or policies
  • External links are provided for convenience; we don't endorse or control external content

Limitation of Liability

  • To the extent permitted by law, HoverNotes LLC is not liable for indirect, incidental, or consequential damages
  • Our liability is capped at the amount you've paid for the service
  • We're not responsible for data loss - please maintain backups of your notes
  • This limitation of liability is subject to applicable laws and regulations

Governing Law

These Terms are governed by the laws of California, United States, excluding conflict of law rules. Any disputes shall be resolved in the courts of California.

Processing Time Terms

  • Processing time is purchased as one-time payments for specific packs
  • Processing time is measured in minutes of AI video analysis
  • Processing time never expires once purchased
  • Purchases are non-refundable unless required by law
  • We may change pricing with advance notice for future purchases

Acknowledgment

By using HoverNotes, you confirm that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy.

Communications

By using HoverNotes, you consent to receive communications from us regarding service updates and promotional content. You can opt out of promotional communications by contacting us at hovernotes@protonmail.com.

Acceptable Use

  • Do not use the service for illegal purposes
  • Do not attempt to reverse engineer the extension
  • Do not abuse or overload our AI processing services
  • Do not share your premium account access
  • Abuse includes excessive requests or attempts to bypass usage limits
  • We reserve the right to suspend or terminate accounts that violate these terms

Billing and Refunds

  • Credit packs are one-time purchases
  • No recurring charges or subscriptions
  • Refunds may be considered for technical failures or billing errors
  • Price changes will be communicated in advance
  • All refund requests are evaluated on a case-by-case basis

Disclaimers

  • The service is provided "as is" without warranties
  • We are not responsible for the accuracy of AI-generated content
  • We do not guarantee uninterrupted access to the service
  • Obsidian integration may be affected by Obsidian updates

Changes to Terms

We may update these terms from time to time. Significant changes will be communicated through our website or extension interface. Continued use after changes constitutes acceptance.

Copyright Policy and DMCA Notice Procedure

We respect the intellectual property rights of others and expect our users to do the same. It is our policy to respond promptly to claims that content created or processed through HoverNotes infringes on the copyright or other intellectual property rights of any person or entity.

Reporting Copyright Infringement

If you believe that your copyrighted work has been used or reproduced in a way that constitutes copyright infringement, please submit a notice to our designated Copyright Agent at the contact information below. Your notice must include the following information:

  • A physical or electronic signature of the copyright owner or a person authorized to act on their behalf;
  • Identification of the copyrighted work claimed to have been infringed, or, if multiple works are involved, a representative list;
  • Identification of the material that is claimed to be infringing, with sufficient detail to allow us to locate it within the Service;
  • Your contact information, including your name, address, telephone number, and email address;
  • A statement that you have a good faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law;
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.

Counter-Notification Procedure

If you believe your content was removed or disabled due to a mistake or misidentification, you may submit a counter-notification to our Copyright Agent. Your counter-notification must include:

  • Your physical or electronic signature;
  • Identification of the material that was removed or disabled and its location before removal;
  • A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification;
  • Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located (or the District of New Mexico if your address is outside the United States), and that you will accept service of process from the person who provided the original notice or their agent.

Send your counter-notification to the same Copyright Agent contact details above, with the subject line: "DMCA Counter-Notification."

Repeat Infringers

In accordance with the DMCA and our policies, we reserve the right to terminate the accounts of users who are determined to be repeat infringers. A repeat infringer is a user who has been notified of infringing activity more than twice and/or has had content removed from the Service more than twice for infringement.

We will review all notices promptly and take appropriate action, which may include removing or disabling access to the allegedly infringing content, notifying the user responsible, and, where applicable, restoring content after a valid counter-notification, in compliance with applicable laws.
